These Terms of Service ("Terms") are a binding agreement between you ("Customer", "you") and PHS Lift ("PHS Lift", "we", "us") covering your access to and use of our website, products, and services. By placing an order, you agree to these Terms.
1. Acceptance
By submitting an order, creating an account, or using any feature of phslift.com, you confirm that you have read, understood, and agree to these Terms and to our Privacy Policy. If you are placing an order on behalf of a business, you represent that you have authority to bind that business.
2. Orders & Pricing
All product listings on phslift.com are an invitation to offer, not a binding offer. Your order constitutes an offer to purchase, which PHS Lift may accept or decline at our discretion. We will confirm acceptance by email once payment authorization and inventory are verified.
- Pricing. Prices are quoted in U.S. dollars and exclude freight, applicable sales taxes, and any required permits. Prices are subject to change without notice; the price in effect at order confirmation governs the transaction.
- Stock. "In stock" reflects our best information at the time of listing. Inventory can change quickly. If a product becomes unavailable after your order, we will offer (a) an equivalent substitute, (b) an updated lead time, or (c) a full refund.
- Specifications. Manufacturer specifications may change without notice. Customer is responsible for confirming that selected equipment meets the specific application requirements (load capacity, lift height, aisle width, operating environment, regulatory requirements).
3. Payment Terms
We accept Visa, Mastercard, American Express, ACH/bank transfer, wire, and Stripe-processed payments. Approved business accounts may qualify for Net-30 or equipment financing through our partners.
- Authorization. Card payments are pre-authorized at order placement and captured at shipment.
- Net-30. Net-30 terms require credit approval. Past-due balances accrue interest at the lesser of 1.5% per month or the maximum rate permitted by law.
- Financing. Financing through third-party lenders is subject to the lender's credit terms. PHS Lift is not a party to the loan and is not responsible for lender decisions.
- Sales tax. Sales tax is collected where required. Tax-exempt customers must provide a valid resale or exemption certificate before order acceptance.
4. Shipping & Freight
PHS Lift ships material handling equipment via FedEx Freight and R+L Carriers. Freight rates shown at checkout are pulled live from carriers and reflect business-address delivery to a standard commercial loading dock.
- Liftgate / inside delivery / appointments. Residential delivery, liftgate service, inside delivery, scheduled appointments, and limited-access locations may incur accessorial fees not visible at checkout. We will notify you before charging accessorials.
- Title and risk of loss. Title transfers upon carrier pickup at the originating warehouse. Risk of loss in transit is governed by the freight contract — see Section 5.
- Delivery dates. Estimated transit times are not guaranteed. Customer may not refuse delivery, cancel, or claim damages due to common carrier delays.
5. Inspection & Damage
Inspect every shipment before signing the delivery receipt. Note any visible damage, missing items, or pallet/crate compromise on the carrier's delivery receipt at the time of delivery.
- Visible damage. Must be noted on the bill of lading at delivery. Photographs strongly recommended. Email [email protected] within 48 hours.
- Concealed damage. Discovered after delivery, must be reported within 5 business days. Retain all packaging.
- Shortages. Must be reported within 5 business days of delivery.
Failure to follow this procedure may void freight-damage claims. PHS Lift will assist with carrier claims but cannot guarantee carrier acceptance.
6. Returns & Cancellation
- Order cancellation. Orders may be canceled at no charge before the unit ships. Once shipped, cancellation requires a return (see below).
- Returns. Returns are accepted within 30 days of delivery, for unused, undamaged equipment in original packaging. A restocking fee of 15–25% may apply. Customer is responsible for return freight.
- Non-returnable. Custom-built, special-order, modified, used, or damaged equipment is non-returnable. Batteries and chargers that have been activated are non-returnable.
- RMA required. Contact [email protected] to receive a Return Merchandise Authorization (RMA) before shipping.
7. Warranty
All new Noblelift equipment is covered by the manufacturer's standard 36-month limited warranty with class-dependent hour caps (whichever comes first), beginning on the date of delivery. Extended warranty plans are available for purchase.
The manufacturer warranty covers defects in materials and workmanship under normal use and properly performed maintenance. It does NOT cover:
- Damage caused by misuse, accident, neglect, overloading, or operation outside published specifications
- Normal wear items (tires, brake pads, forks subjected to abuse, lights, fuses)
- Damage from modifications, unauthorized attachments, or non-OEM parts
- Damage from failure to perform scheduled maintenance
NO OTHER WARRANTIES, EXPRESS OR IMPLIED, ARE PROVIDED BY PHS LIFT. PHS LIFT EXPRESSLY DISCLAIMS THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE to the maximum extent permitted by law. Warranty is the exclusive remedy.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PHS LIFT'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS, THE PRODUCTS, OR THE SERVICES SHALL NOT EXCEED THE PURCHASE PRICE PAID FOR THE SPECIFIC PRODUCT THAT IS THE SUBJECT OF THE CLAIM.
PHS LIFT SHALL NOT BE LIABLE FOR INCIDENTAL, CONSEQUENTIAL, SPECIAL, INDIRECT, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST PRODUCTION, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
9. Indemnification
Customer agrees to indemnify, defend, and hold harmless PHS Lift, its officers, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from (a) Customer's misuse of equipment, (b) failure to operate equipment in accordance with manufacturer instructions and applicable OSHA standards, (c) failure to train operators, or (d) breach of these Terms.
10. Intellectual Property
All content on phslift.com — including text, images, logos, product descriptions, buying guides, and software — is the property of PHS Lift or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without express written permission.
11. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms shall be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, in Cook County, Illinois. Each party waives the right to a jury trial and to participate in class actions.
12. Changes to These Terms
PHS Lift may update these Terms from time to time. Material changes will be posted at this URL with an updated effective date. Continued use of the site or placement of new orders after the effective date constitutes acceptance.
